ZIGGY attaches great importance to your privacy and therefore protects your personal data with the best possible care.

  1. PERSONAL DATA THAT MAY BE PROCESSED

ZIGGY only collects and processes the personal data which it receives from you when you use its services or purchase its items. These personal data concern data that allow a natural person to be identified directly or indirectly. Depending on whether you only contact us or whether you also purchase one of the items of ZIGGY on the website https://www.historyofmyworld.com, the personal data that are collected and processed might differ. The personal data that are collected and processed can be your first name, last name, email address, language, billing address, delivery address, telephone number, mobile number, purchases, payment method, payment details and IP-address.

You are responsible for the accuracy of the personal data you provide to ZIGGY.

 

  1. PROCESSING PURPOSES AND LEGAL BASES FOR PROCESSING

ZIGGY ensures that your personal data are processed lawfully, fairly and transparently. Below you are informed in detail for what purposes and on the basis of which legal basis your personal data are processed.

 a) Personal data processed when contacting ZIGGY

Your personal data (first name, last name, email address, mobile number) will be processed when filling in the contact form on the website https://www.historyofmyworld.com. When contacting ZIGGY by email, telephone or letter the following personal data will be processed, depending on the method of contact (first name, last name, address, telephone number, mobile number). In order to enable ZIGGY to answer your queries or to respond to your complaint, the aforementioned personal data will be used. No telephone conversation will be recorded or stored.

The email address that was provided to ZIGGY, may be used by ZIGGY to send out surveys in order to improve its service.

The legal basis for processing the aforementioned personal data in order to respond to your query or to your complaint is your consent. The using of your email address to send out any survey is based on the legitimate interest of ZIGGY.

 b) Online account

The following personal data are provided to ZIGGY when you create an online account: first name, last name, title, email address, language, billing address, delivery address(es), telephone number, mobile number and IP-address.

Your login details (email address and password) will be saved for the further use of your online account. In order to avoid that you would have to enter your personal data again and to enable ZIGGY to identify you as a customer, all the other aforementioned personal data will be saved by ZIGGY in its customer system and stored in your online account.

The legal basis for processing the aforementioned personal data with regards to the creating of an online account, is your consent.

 c) Online orders

When placing an order on the webshop of ZIGGY the following personal data are processed: first name, last name, title, email address, language, billing address, delivery address, telephone number, mobile number, IP address and payment details. These personal data are processed to finalize your payment, to send an order confirmation, to issue and send an invoice, to deliver your order and to keep you informed of the status of your order.

The legal basis for processing the aforementioned personal data is the necessity to enter into and to perform the purchase contract.

 d) Legal requirement

Sometimes the processing activity with regards to the personal data provided to ZIGGY is necessary to comply with a legal obligation of ZIGGY. The most important obligations relate to tax law and the relating accounting, trade law and any laws with regards to consumer transactions.

The legal basis for this processing activity is a  legal obligation.

 e) Direct marketing communication

When subscribing to our newsletter, you provide the following personal data: first name, last name, email address, title, country, zip code and language. The legal basis for sending newsletters is your consent. Besides sending newsletters, these personal data that you provide to ZIGGY may be used for other direct marketing communications such as for instance actions, promotions, the announcement of benefits and events. The legal basis for these other direct marketing communications is the legitimate interest of ZIGGY.

In doing so, ZIGGY is always taking care to insure that there is a sound balance between your right to privacy and the legitimate interest of ZIGGY. 

At all times you have the right to opt out of any ‘direct marketing activities’. The opportunity to do so will also be provided in every direct marketing activity.

 

  1. PERSONAL DATA TRANSFER

ZIGGY will never transfer personal data to third parties, unless:

  • with any affiliated company, for the same purposes as specified in this privacy policy-document;
  • this is necessary for the performance of the purchase contract;
  • with third party service providers who provide services on our behalf to assist ZIGGY in its business activities. Your personal data can only processed by these service providers in a limited way, i.e. in accordance with the instructions of ZIGGY for the performance of their duties. The contractual conditions of these service providers have to be in accordance with the General Data Protection Regulation (GDPR). These service providers have to guarantee the same technical and operational securities as ZIGGY does. ZIGGY cooperates for instance with service providers for the following activities:
  • management and hosting of the website https://www.historyofmyworld.com;
  • processing of payments;
  • management of the customer database;
  • order delivery;
  • certain marketing actions;
  • organization of events;
  • to fulfil any legal obligation of ZIGGY such as for instance towards the tax authorities;
  • with your explicit consent;

ZIGGY restricts the transfer of your personal data to countries outside the European Economic Area (European Union + Iceland, Norway and Liechtenstein) as much as possible. In case your personal data are being transferred to parties in third countries, such as for instance software suppliers and cloud or mailing services, ZIGGY will take all necessary measures to ensure that your personal data are only processed in accordance with data protection regulations and this privacy policy-document. These data protection regulations may include binding corporate rules, contractual clauses guaranteeing an adequate level of protection or approved certification mechanisms;

 

  1. THE RETENTION PERIOD OF YOUR PERSONAL DATA

In general, all your personal data are being stored in the information system of ZIGGY for no longer than necessary to provide the service(s) or for the aforementioned purposes.

The personal data that ZIGGY collects on the basis of your consent will be stored as long as your consent won’t be withdrawn.

The personal data that are sent in order to have ZIGGY responded to your question or complaint, will be kept as long as it is necessary to enable ZIGGY to fully respond to the question or complaint, as well as 2 more years from the last response on your behalf or on behalf of ZIGGY. These files, including your personal data, will be kept by ZIGGY in order to consult related questions or complaints for the purpose of optimizing its services.

ZIGGY will keep information about your purchases, including your personal data, for as long as reasonably necessary to perform its agreements, to comply with its legal obligations (for instance accounting and tax obligations), as well as to resolve disputes or enforce agreements. Consequently these personal data are kept 10 years after the contractual relationship.

In all cases, personal data may be kept for a longer period if there is a legal or regulatory reason. They can be kept for only a shorter period of time if you object to the processing of your personal data and if there is no longer a legitimate or legal reason and if the data are no longer required to perform the purchase contract.

 

  1. YOUR RIGHTS WITH REGARDS TO YOUR PERSONAL DATA

Hereafter your rights with regards to your personal data are enumerated. If you wish to exercise any of these rights, ZIGGY will comply with your request within one month of receiving your request. You can exercise these rights by contacting us on the addresses to be found in article 2 of this privacy policy-document.

 a) Your right to request access to your personal data

You are entitled at any time and free of any charge to request access to your personal data, to the purpose(s) of the processing of these data and to request a copy of your personal data;

 b) Your right to request rectification or completion of your personal data

You can request at any time and free of charge to have your incorrect personal data corrected and/or your incomplete data completed.

 c) Your right to object to the processing of your personal data

You have the right to object the processing of your personal data. However such request can be denied by ZIGGY when justified. Examples of such justification are the legal obligation to retain certain data and the necessity to perform a purchase contract.

 d) Your right to request restriction of processing your personal data by ZIGGY

You are entitled to request restriction of processing your personal data if you suspect that your personal data are wrong, the processing is unlawful or if you don’t agree that ZIGGY uses your personal data for direct marketing activities.

Your request will be honoured unless there are compelling reasons not to do so. Examples of denying such request are to prevent fraud or defaults on payments.

 e) Your right to request erasure of your personal data

You can ask us to have erased your personal data at all times. However when justified, ZIGGY may deny this request. Examples of such justification are the legal obligation to retain certain data and the necessity to perform a purchase contract.

 f) Your right to withdraw your consent

You are entitled to request at any time to have withdrawn your consent. However when justified, ZIGGY may deny such request.

 g) Your right to request portability of your personal data 

You are entitled to ask to receive your personal data in a structured, commonly used and machine-readable format and you have the right to transmit those data to another data controller without hindrance of ZIGGY. 

In exercising this right, you have the right to have those personal data transmitted directly from ZIGGY to another data controller, where technically feasible.
